Recently was in Denver Co. waiting to pickup a load going back to Boise, Idaho. Was looking forward to getting back home, had been out 4 weeks. I had NEVER been out that long before,,,this economy has forced alot of us to do alot of things or haul alot of things that we would never had thought twice about.
Since I'm a OO with my own authority I was waiting on the load confermation, which I had recieved on 12/23/08. The load didn't pick up until the the next morning 12/24/08. This load would get me back home to spend the holidays with my family. Got there to pickup the load that morning and the shipper was closed. I was unable to get ahold of the broker to find out what was going on because they to had closed up.
I made the decision to stay there and hope they would be open the the morning of the 12/26/08 which they were. It was to far to dead head all the way home, 850 miles and since I had agreed to the load I felt I was responsable for picking it up.
What I would like to know, which I've tried to research, is the broker responsible for the detention time, 2 days worth, which also falls under the truck ordered not used regulations and if so how much. I know part of this is covered under the FMCSA regulations, but where ? I know I'm intitled to some type of compensation.
Wouldn't be so bad, but it in 30 years I've NEVER been away from my family for the holidays and for an additional 2 days. This is in know way any of my fault, so where do I stand ? I'm I screwed. Seam like the trucker is always on the bottom of the pole when it comes to taking it up the ARS.
If anyone can point out the sections in the FMCSA I would surley appreciate it. Thanks Dave S.
