For years and years, drivers have been complaining about detention time and wanting to charge shippers and receivers for the time they have lost just waiting.
Can you just charge a shipper or receiver for time spent waiting? Not really. Most shippers and receivers are going to tell you that they need 1-2 hours to load or unload you. So if you've been waiting for an hour and a half, don't think they are going to start paying you.
The time to negotiate detention time is before you pick up the load. You need to have somewhere in your rate confirmation the explanation for detention time. For example: Your rate confirmation (either with the broker or direct shipper) should have that you allow the shipper and/or receiver 2 hours maximum loading/unloading time. After that, they will be charged $50 per hour. Make sure your rate confirmation is signed by someone authorized to do so. Also, make sure you have the shipper/receiver write your in and out time on the BOL along with their signature.
Always have things in writing, whether it is lumper fees, tarp pay, stop off pay, etc...If it is in writing, then you can enforce it. This is your business, make sure you are getting paid for the work you do.
